The
Aboveground Petroleum Storage Act was amended in 2007 by Assembly Bill 1130 (Laird).
This bill made specific changes to the existing Act, including passing the responsibility
for administering the Act to the CUPA.
All tank facilities
with a storage capacity of 1,320 gallons or more of "petroleum" in aboveground
tanks are subject to the Act. Businesses that are subject to this law are required
to file a storage statement with the CUPA and, with certain exceptions, prepare
and implement a federal Spill Prevention Control and Countermeasure (SPCC) Plan.
The object of the SPCC plan is to prevent discharges of petroleum from causing
water pollution.
