Food Vending Permit Requirements

The following conditions must be completed before a Food Vending Permit can be issued to operate a retail food facility within Kings County:

  • A permit application must be completely filled out. (If you are permitting a vehicle, a commissary letter of approval must also be completed.) Forms with incomplete information cannot be processed for approval. Prior to issuance of a Food Vending Permit all the applications must have written approval by the assigned Environmental Health Officer.
  • A new facility or an existing facility that is being remodeled requires prior plan check approval. Plans must be submitted to and approved by this office before any work is started.
  • A Food Vending Permit cannot be issued nor can final approval to open for business be given until a final inspection is completed by this Department. It is your responsibility to make an appointment for a final inspection.
  • All Food Vending Permit and plan check fees must be paid in full before a permit can be issued.
  • Contact all other appropriate agencies (i.e. Local Planning, Building and/or Fire Departments) to follow through with their requirements.
  • A Food Vending Permit will be issued once all of the above items have been satisfactorily completed.
  • If you are applying for a permit for a vehicle (mobile food facility), the name, address, and telephone number of the owner, operator, permittee, business name, or commissary shall be legible, clearly visible, and permanently indicated on at least two sides of the exterior of the mobile food facility. State law specifies that the name shall be in letters at least 8 centimeters (3 inches) high and shall have strokes at least 1 centimeter (3/8 inch) wide, and shall be of a color contrasting with the mobile food facility exterior. Letters and numbers for address and telephone numbers shall not be less than 2.5 centimeters (one inch) high.
